Drafting

 

Inter-partes : One of our specialists will draft your Bill of costs and return it to you with all accompanying documents ready for you to serve on your opponent.

 

Legal aid : One of our specialists will draft your Bill of costs and return it to in readiness for you to file at Court / the Legal Services commission.


Drafting and negotiation (civil law cases only)



One of our specialist draftsmen will prepare a Bill of costs and we undertake the detailed assessment process on your behalf.

Once a Bill of costs has been drafted, it is sent to you by email or dx for you to check and approve. Any amendments can be undertaken via email. Once approved, you will sign the certificates that are annexed to the Bill and return it to us whereupon we commence the detailed assessment process (by serving N252, Bill, fee notes on the paying party.

If Points of dispute are served, one of our specialist draftsmen prepare a schedule of replies thereto and after a short period of time (allowed to exhaust the negotiation process*), we would apply to have the matter set down for detailed assessment whereupon one of our advocates or Costs Counsel if the case requires is briefed for and will attend upon the final costs hearing.

 

*Our team of expert negotiators undertake negotiations once the Bill of costs has been served. They follow strict protocols to ensure that no time is lost in pursuing the recovery of maximum costs. Your instructions will be taken upon any offer that we deem to be within the bracket of reasonableness.

The claim for costs will be resolved at detailed assessment or once we have agreed favourable settlement terms. We do not charge for our services until such time as the claim for costs is resolved.

Once the claim for costs is resolved, we render an invoice which is not payable for 60 days. This time enables you to recoup your costs prior to discharging our account. Our fee is based on a £100 per hour charging rate – this is claimed within the Bill of costs and recoverable as against the paying party. If we do not resolve your claim for costs prior to having to serve a schedule of replies to points of dispute, these are prepared applying the same charging rate (again this charge is recoverable as against the paying party). If we have to attend a detailed assessment hearing, our advocacy charge is £100 per hour and if the matter is more suited to costs Counsel, we would brief Counsel and Counsels charges would be no more than our hourly charging rate.
